This influence has not always been linear, as it has had both positive and negative effects. The courts have sometimes acted as a brake on the evolution of the system, at other times they have sought a balance between respect for tradition and new social challenges, and there have been cases in which they have brought about a change in the conception of legal structures to promote the recognition of freedom and equality.
