AB - After decades of stable application of the legal framework governing compensation for unfair dismissal, the 2012 labour reform –along with the Constitutional Court’s doctrine on diffuse control of conventionality and the entry into force of the European Social Charter– has sparked criticism regarding the reduction of compensation amounts and the introduction of statutory limits. The first part of this article examines the requirement for adequate compensation under ILO Convention No. 158 (1982) and the persuasive but non-binding nature of the pronouncements of ILO supervisory bodies. The second part assesses the adequacy of the domestic legal framework, arguing that judges and courts cannot directly apply Article 10 of ILO Convention No. 158. It also explores the potential compatibility, in certain cases, of financial compensation for unfair dismissal with claims for additional damages and proposes reforms to the existing legal framework. The study’s conclusions may also contribute to clarifying some of the contentious issues surrounding Article 24 of the European Social Charter and the legal weight of the European Committee of Social Rights’ pronouncements.
