Boston judge orders release of 13-year-old from ICE custody
A federal judge in Boston ordered the release of a 13-year-old boy who was arrested by Immigration and Customs Enforcement (ICE) agents and is being held at the agency's temporary holding facility in Burlington.
On Friday, Judge Richard G. Stearns ordered that the boy be released by Tuesday unless ICE and the Department of Homeland Security can show grounds for why he should be detained, according to court documents.
Stearns noted that the boy is being held "presumably in the company of unrelated adult detainees."
"Unless respondents show cause by close of business on Tuesday, Oct. 14, 2025, for grounds justifying the detention of a juvenile in these circumstances," the boy must get a hearing to consider bail before an immigration judge no later than Oct. 17, Stearns' order reads.
It is unclear where the boy was arrested and why. Because he is a juvenile, the records detailing his arrest and detainment are not public.
In May, another teenager, Marcelo Gomes Da Silva, was arrested by ICE in Milford. He was detained for six days at the agency's field office in Burlington before being released .
He said during the six days in custody, he was surrounded by adult men, and he was uncomfortable using the bathroom in front of others. He slept on concrete floors using a mylar blanket.
"It's not a good spot to be. Nobody should be in here ," Gomes Da Silva said, speaking to reporters outside of the Burlington facility after his release pending future immigration hearings.
A student of Milford High School, Gomes Da Silva, told MassLive in September that he has become more cautious and has been going out less in recent days, saying that ICE is back in his hometown.
While ICE has not shown up at his house, he said he is worried nonetheless.
"I'm nervous for me and people around me," Gomes Da Silva said.
