Top Democrat Warns Stephen Miller to ‘Lawyer Up’ After Trump Promotes Him
Rep. Robert Garcia (D-CA), the top Democrat on the House Oversight Committee, has a blunt message for Stephen Miller following his promotion to White House chief of staff: "Lawyer up."
Garcia issued the warning Friday after President Donald Trump announced that Miller, the architect of his regime's aggressive immigration crackdown, would replace Susie Wiles as White House chief of staff beginning Monday, November 9.
The announcement comes just days after Republicans suffered devastating losses in the midterm elections, with Trump responding to the electoral rebuke by elevating one of the most controversial and unpopular figures in his regime.

"Just days after the American people rejected his corrupt and lawless presidency, Donald Trump is doubling down," Garcia said in a statement released by House Oversight Democrats.
"Stephen Miller is the architect of the unconstitutional ICE raids that have terrorized our communities and kidnapped and killed American citizens and immigrant families."
Garcia made clear that Miller's promotion would not insulate him from congressional scrutiny.
"Oversight Democrats will continue to investigate Miller for his misconduct, and we will fight against his hateful policies in Congress and the courts," Garcia said.
"Stephen Miller should lawyer up."
The warning carries particular significance as Democrats prepare to assume control of the House following their midterm victories, giving them the opportunity to wield subpoena power and launch investigations into the Trump regime.
As the ranking Democrat on the House Oversight and Government Reform Committee, Garcia has been among the regime's most outspoken congressional critics. His statement signals that Miller's conduct could become a major focus of Democratic oversight efforts.
And Miller has given lawmakers plenty to examine.
As Trump's deputy chief of staff, Miller has been a driving force behind the regime's mass deportation campaign, pushing aggressive immigration enforcement measures and expansive interpretations of executive authority.
In May 2025, Miller publicly acknowledged that the regime was considering suspending habeas corpus, the constitutional protection that allows people detained by the government to challenge their imprisonment in court.
"The Constitution, which is the supreme law of the land, allows for the suspension of the writ of habeas corpus in times of invasion," Miller told reporters, adding that the regime was "actively looking at" the possibility.
Under the Constitution, habeas corpus may be suspended only in cases of rebellion or invasion when public safety requires it. Miller's remarks raised serious concerns about the regime's willingness to undermine fundamental legal protections.
His promotion now places him in an even more powerful position, overseeing White House staff operations and helping shape the president's agenda.
It also comes despite Miller's dismal public standing.
A March 2026 poll reported by GB News ranked Miller as the least-liked of 27 prominent political figures surveyed, making Trump's decision to elevate him after an electoral shellacking all the more remarkable.
Trump announced the personnel shake-up on Truth Social, praising Miller as "one of my most trusted advisors" and declaring that Wiles would move to the "Trump Political Operation."
Just weeks earlier, Trump had insisted there was "zero chance" he would replace Wiles.
But following the midterm disaster, Trump has done exactly that, replacing her with the hardline adviser most closely associated with some of his administration's most extreme policies.
For Garcia and House Democrats, the promotion appears to have only strengthened their determination to hold Miller accountable.
And with Democrats preparing to take control of the House, Garcia's warning is more than a political insult. It is a preview of the congressional investigations Miller could soon face.
