  • Lindsay Clancy's murder trial ended in a mistrial after jurors were unable to reach a unanimous decision on her criminal responsibility for killing her three children.

Lindsay Clancy 's closely watched murder trial ended without a verdict after jurors failed to break a prolonged deadlock over whether the Massachusetts mom was criminally responsible for killing her three children.

Judge  William Sullivan  declared a mistrial on Friday, September 4, after the jury told the court that it remained  unable to reach a unanimous decision following days of deliberations.

According to The New York Post , the mistrial ruling is not yet final because Lindsay's attorney has one hour to file an emergency appeal challenging the decision.

Lindsay, 36, has admitted to strangling her children, 5-year-old Cora, 3-year-old Dawsonand 8-month-old Callan— whom she shared with ex-husband Patrick Clancy — at the family's Duxbury, Massachusetts, home in January 2023.

Her defense argued that severe postpartum psychosis clouded her judgment so completely that she could not grasp what she was doing. Prosecutors countered that she understood her actions and knew right from wrong at the time of the killings.

Jurors had reported being deadlocked twice before the mistrial .

As Globe previously reported on September 2, Sullivan previously instructed them to continue deliberating and issued a Tuey-Rodriguez instruction, sometimes called a "dynamite charge," urging the panel to reconsider one another's views while remaining true to their own judgment.

The mistrial leaves Lindsay facing the same criminal charges while prosecutors decide what comes next.

The Plymouth County District Attorney's Office must now decide whether to retry the case before a new jury.

Boston defense attorney and former prosecutor Brad Bailey, who is not involved in the case, told the Associated Press on September 2 that prosecutors could also consider resolving the case through a plea agreement.

"Any time the threat of a retrial with murder one hanging over the client is re-interjected, defense lawyers will, at the very least, explore whether or not there's any interest in a resolution," Bailey said.

Lindsay remains held at Tewksbury Hospital, where she has been receiving psychiatric treatment since her arrest in January 2023.

A guilty verdict could put Lindsay behind bars for the rest of her life, while a not guilty finding due to mental illness could instead land her in long-term psychiatric care.

The mistrial leaves the case without a verdict and shifts the next major decision to prosecutors. They must now determine whether to bring Clancy before a new jury or pursue another path to resolve the case.
