レッスン５　－　Rights（１）

今、夜１１時を回ったところです。

やっと今日の勉強を終えました。

朝からばたばたしてから、ログイン時間を短くするためにやり方を新しくしたため、午前中はプリントアウトだけで終わってしまいました。

その後、不動産屋さんと、抵当流れ物件やfix up 物件などを６件ほど見て回り、帰ってからやり始めたらこの時間。

ということで、今日のレッスン。

今日から新しい章「Rights:権利」に入りました。

です。例によって、赤字の部分が今日やったところ。

各節の後部に書いてあるのが、それぞれのページ数。この章全体で２２５ページになりますが、これを全部はじめにプリントアウトしてから、内容に入りました。

一応予定では、この章、全１８節を６日以内にやる予定で、今日の予定が１～６までの６節でした。

この内容はそれぞれ、

１．Government Rights　（全２４ページ）

　・ Distinguish between the feudal and allodial system of land ownership.

　・ Define and understand the right of eminent domain.
　・ Distinguish between the right of taxation and the right of escheat.

３．Private Ownership　（全１４ページ）

　・ Identify the four main rights which make up the bundle of rights.
　・ Define and understand the term right of possession.
　・ Define and understnad the term right of control.
　・ Define and understand the term of enjoyment.
　・ Define and understand the term of disposition.
　・ Identify and understand how individual rights may be separated from the bundle.

５．Estates in Land　（全７ページ）

　・ Define and understand the term estate.
　・ Identigy the difference between Possessory estates and nonpossessory estates.

という内容です。

私有権に対する公的権利の優先や質流れによる権利の没収など、不動産に関するビジネスを営む上では欠かせない「権利」の優先順位やその範囲などが主な内容です。

面白いのは、PETEというアクロニム（頭文字を合わせて作った言葉）を使うと覚えやすいですよ、という親切な（？）助言まで入っています。

このPETEは、例えば、次の言葉の頭文字を合わせたもので、現代の完全私有地制の中での４つの公的制限についてのキーワードです。

1) P - Police Power (安全・治安の確保に関する権利）
2) E - Emenent Domain　（土地収用権）
3) T - Taxation　（課税・徴税権）
4) E - Escheat　（没収権）

また、完全所有、区分所有、リースなどの各場合の権利の範囲などのお勉強でした。
