Aug. 13, 2007 (Investor's Business Daily delivered by Newstex)
Fans of open-source software are breathing easier after a ruling reduced the legal threats against their most pervasive product, the Linux operating system.
U.S. District Judge Dale Kimball ruled late Friday that the SCO Group (NASDAQ:SCOX) SCOX doesn't own the copyright to the Unix operating system, striking a big blow to SCO's claim that Linux improperly uses software code from Unix, analysts say.
SCO claimed it owned the applicable Unix copyrights in a pending lawsuit it filed in 2003 against IBM (NYSE:IBM) IBM. SCO has long threatened suits against Linux users.
Kimball, though, ruled that business software maker Novell NOVL owns the copyrights to Unix software, which it acquired from AT&T. (NYSE:SBT) (NYSE:T)
Novell is a Linux provider -- and it doesn't see any conflicts between Linux and Unix, says Joe LaSala, general counsel for Novell.
