INDIANAPOLIS — Former NFL player and Fox Sports analyst Mark Sanchez filed a guilty plea Thursday in his case involving a drunken fight downtown that resulted in Sanchez being stabbed and hospitalized after attacking 69-year-old Perry Tole.
Sanchez faced multiple charges after the incident at 12:30 a.m. Oct. 4, including felony battery causing serious bodily injury, battery resulting in bodily injury, unauthorized entry of a motor vehicle and public intoxication.
Sanchez's case was set to go before a jury next week. The details of the plea deal filed in Marion County Superior Court 21 have not been released. IndyStar reached out to Sanchez's attorney, Jennifer Lukemeyer, but did not immediately receive a response.
Sanchez also asked in his filing Thursday that a sentencing hearing be set. The judge in the case has not yet accepted the plea nor set a sentencing.
"This incident brought significant national attention to our city, including false narratives spread by commentators and public officials before the evidence was available," Zachary A. Myers , former U.S. Attorney for the Southern District of Indiana and a litigation partner with McCarter & English , said in a statement to IndyStar. "Now that Mark Sanchez intends to plead guilty to a crime, the public will want to see whether he will be treated the same as others who commit similar offenses."
Sanchez's older brother, Nick Sanchez, Jr., who is also his legal adviser sent a statement to IndyStar.
"This (plea) is a positive development. We are finalizing an agreement with the prosecutor's office that provides a path toward resolving the state's case," he said. "We're also encouraged by the constructive conversations taking place regarding the related civil matter. There is real momentum toward bringing this entire chapter to a close."
What happened in the Mark Sanchez case
Sanchez, who was in Indy to cover the Indianapolis Colts-Las Vegas Raiders game, spent the evening of Oct. 3 at St. Elmo Steak House. Sanchez left the restaurant on foot and inebriated, according to court documents.
As Tole was working the late shift for a cooking oil recycling company, Sanchez approached him and confronted him near a downtown Indianapolis hotel loading dock.
Surveillance video from a neighboring hotel showed Sanchez grabbing and throwing Tole into an alleyway, who pepper-sprayed and then stabbed Sanchez to fend off the attack, court records show.
Sanchez was stabbed shortly before 12:30 a.m. Oct. 4 in an alleyway near Loughmiller's Pub & Eatery . He suffered stab wounds to his upper torso and was rushed to Eskenazi Hospital in critical condition. Later in the day, he was upgraded to stable condition.
Court documents indicate Tole, who suffered a laceration to his left cheek, was defending himself. He was treated and released from Methodist Hospital. Photos Tole shared with IndyStar show him on a hospital bed, bloodied, with a neck brace and a large gash on the left side of his face.
"This incident should never have happened," said Marion County Prosecutor Ryan Mears, at the time. "What began as a disagreement between a 38-year-old former professional athlete and a 69-year-old man should not have escalated into violence or left anyone seriously injured."
The aftermath of the Mark Sanchez case
Tole filed a lawsuit against Sanchez and his then-employer, FOX Corporation, two days after the attack. He filed an amended complaint on Nov. 21 , alleging Sanchez was overserved alcohol while at a Huse Culinary establishment on the night of the attack.
"We are pleased with the constructive and professional conversations we've had with Mr. Sanchez's team. Our discussions have been productive and we're on a positive path toward an agreement that will allow the parties to move forward," Matt Golitko, attorney for Tole, said in a statement to IndyStar. "Mr. Tole appreciates the progress we have achieved and looks forward to an amicable resolution."
In November, Fox Sports fired Sanchez, who came to the network in 2021 as a game analyst. Fox replaced him with Drew Brees.
Sanchez had a 10-year career in the NFL, including four seasons with the New York Jets and time in Philadelphia, Dallas and Washington. He retired in 2019.
