of boys and girls forcefully emigrated
to foreign regions.
This is the decision of the I nterna-
tional C riminal C ourt to issue an
arrest warrant for Russian President
Vladimir Putin for his involvement in
a war crime in which children were
illegally abducted from the occupied
territories over Russia's invasion
of Ukraine.
The International Court of Justice (ICJ),
also based in The Hague, differs from
the ICC,which adjudicates individuals,
in that it handles legal issues between
states.
The independence of the ICC is based
on checks and balances between States
Parties and the UN Security Council.
The ICC will only try war crimes
"complementarily" if the state owed to
do so does not have the "capacity" or
"willingness" to do so.
The "jurisdiction" that the ICC can
exercise is limited to incidents that
occurred after July 2002, 7, and
there is no statute of limitations.
In principle, the defendant must be
a citizen of a Contracting State or
a crime committed within a Contracting
Party.
However, cases referred by the UN
Security Council shall have jurisdiction
in all UN member states.
ここまでは、朝日新聞からの抄訳である。
これによれば、国連メンバーであれば、
ICCのメンバーはICJができない部分を
補完するとして 設立されている。
自国にとって不利として、ICCに署名
しないとしても、
国連加盟国は、特に、常任加盟国は、
国連の設立趣旨から
ICC加盟国同様に守るべきであろう。
都合のいいことは守り、都合の悪いことは
守らないことを許すような国際連合は~
最早～餓鬼どもの集まりに等しく～～～
改組すべきであろう。
