　おっと、こいつは注意が必要だ。安倍晋三氏銃撃殺の容疑で逮捕された山上徹也が、本日7月25日、精神鑑定のために鑑定留置となった。（奈良西警察署から大坂拘置所に移送された；追記）

　鑑定留置理由。
　・・山上容疑者は、これまでの調べに対して、母親が特定宗教団体に多額の献金をしたため破産し、家庭崩壊に至った。ためにその宗教団体に対して恨みを抱くようになり、宗教団体のトップを狙ったが近づけず、（その宗教団体と関係があると思った）安倍晋三氏を襲撃した。・・・この供述について、検察は、特定宗教団体（すでに、旧名・統一教会と判明し、一般に知れている）に対する恨みから安倍晋三氏殺害にいたる間に、「論理の飛躍がある」ので、精神鑑定をすることにした、と述べた。

　私が注意したのは、検察が「論理の飛躍がある」と言っている点である。
　もう一度、山上容疑者の供述を見てみよう。私にはまったく論理に飛躍があるとは思えない。少なくとも山上にとってはきわめて論理的だ。では、検察は何を問題にしたのか？　

　じつはそれも明らかだ。
　検察は、安倍晋三氏と特定宗教団体とに何らかの関係性があるかもしれないという、山上容疑者にとっては重要な点を、なおざりにするか、むしろその関係性を頭から否定的に考えている。あるいは逮捕直後に各メディアが、山上の供述によれば、安倍晋三氏が特定宗教団体と関係があると「思い込んだ」、と報道したように、検察も、「思い込み」として処理しようとしているかもしれない。それが、山上徹也に精神鑑定をするという「理由付け」であると、私は推測する。

　つまり、安倍晋三氏と特定宗教団体は何の関係もないのに、関係があると「妄想」した、というのが検察が考えたストーリ。山上徹也の供述が、精神に異常を来しているがゆえの「論理的破綻」という図式である。このストーリを確定してしまえば、現在、おくればせながら各メディアが探索し報道している安倍晋三前首相と統一教会が関係があるか無いかという問題について、検察は手をつけずにすますことができる。私は、それが検察の考えのような気がする。この考えに添うように、この事件は公判まで運ばれるかもしれない。

鑑定留置期間は7月25日から11月25日までの4ヶ月。ずいぶん長い。

　私は、山上徹也容疑者を銃撃殺人犯としては、まったく弁護しない。しかしながら、この男の起こした事件から、多くの日本国民にとって意外な、日本の広く深い「闇」が露呈しはじめているのかもしれない。そしてその深い闇は、検察組織の奥にも広がっているかもしれない。
　精神鑑定の結果如何で、前首相を銃撃して殺害した犯人に対する量刑に、当然、軽い刑にするか重い刑にするかの問題が出て来よう。普通ならば、重大犯罪者に対する厳罰を要求する検察が、その重い量刑をあえて断念してでも、触れずにおきたいことがあるのかもしれない。それが、検察当局にとっても思いがけず露呈しそうだ。そこで容疑者の「精神鑑定」を考えたのではないか？「国葬」は国民を目隠しするにはまったく都合がよい。

　私は、もちろん、そんなことは無い、と言い切りたいのだ。だが、この鑑定留置については、「上手の手から水」のような胡散臭さを感じないではない。
　私は、私自身の方針として、なるべく推測で物を言わない・書かないことにしている。きょうの記述は、その禁を破った。この事件、検察の動向および後の裁判から判決にいたるまで、今後に注目、注目。

　【追記】
　7月27日 TBS NEWS DIG の映像。・・・現職閣僚等の関係の記者会見において、記者が国家公安委員長・二之湯智氏に対して、旧統一教会教会の「関連団体のイベント『ピースロード』について2018年京都府実行委員会の委員長を務めたのは事実でしょうか」という質問をしたところ、二之湯智国家公安委員長は、「今おっしゃったことは事実です」と応えた。

　・・・国家公安委員会委員長という要職（国務大臣であり、内閣総理大臣に任命され、内閣府に属す）にありながら、早い時期に社会問題になっていた宗教団体に、安易に近づいているのみならずその関連団体のイベントの実行委員長まで引き受けている事実に、私、山田は唖然とするどころか職務逸脱の危険さへ感じる。そして、山上徹也容疑者は、「思い込み」どころか、むしろこの宗教教団と日本の政治家や公職者との浅からぬ関係の実体を良く知っている、といえるかもしれないと私は思う。
　鑑定留置は裁判所の留置状が必要であるが、当事者（つまり山上徹也）は鑑定留置を拒否することができない。また、鑑定受託者（鑑定人）には宣誓義務がない（後註）。
　山上徹也の供述を「論理の飛躍」と言う官憲や精神鑑定人には、充分注意する必要があろうと思う。何かを隠蔽しようとしているかもしれない。その理由として私の推測を述べれば次のようだ。
　つまり、刑事訴訟法の手続きに則り起訴状を作成するにあたり、山上徹也の供述どおり安倍晋三前首相と統一教会との密接な関係が事実となれば、前首相暗殺事件という”単純”な殺人事件に終始しない大きな政治問題に発展する可能性を避けられないだろう。検察はおそらく深いところを知っている。それゆえに、そこを、どうしても避けて起訴したいのではないか。山上徹也に対する精神鑑定の警察・検察の本当の意図は、山上徹也の「真実」とは何の関係もないのではないか、と私は疑念を抱く。

　【註】犯罪容疑者であるけれども一個の人間性を「鑑定」するという、上位者意識の鑑定人に宣誓義務が無いと規定している法律は、じつに奇怪であるが、この法理念は、如何なる考えに基づくのだろう？　
　精神鑑定は、その結果如何では判決の量刑に差異が生じ、それが容疑者を重い刑罰を課せられる可能性から「救済」できる。無罪になる可能性もあるからだ。しかしまた、精神鑑定人自身の人間性によっては、まったく反対に重い刑罰を課す要因ともなる鑑定結果を提出する場合も当然ありうる。そのような事例は過去に存在することが、或る少年犯罪事件に関して報告されている。しかしながら鑑定人に宣誓義務が無いために、鑑定人は如何なる判断をしようとも罰せられることはない。

　語弊を恐れずに述べれば、精神医学は、その発達史に鑑みても、充分に「科学」とは言えない余地を残している、と私は考えている。人間の精神というのは、決して万人を一括りにできないのだ。私たち個々人は、結局のところ、60億分の1の精神の持ち主だということだ。それが人間というものである。

Tetsuya Yamagami, who was arrested on suspicion
of shooting Shinzo Abe, was detained today for a
mental test on July 25.

Reason for appraisal detention:
... Yamagami has stated as follows in response to
the investigation so far. His mother made a large

The investigation and prosecution said they
decided to do a psychiatric evaluation of Yamagami.

I was careful that the prosecution said that there
was a "leap of logic".
Let's look at Yamagami's statement again. I don't
think there is a leap in logic at all. At least for
Yamagami, it's quite logical. So what did the
prosecution have to do with Yamagami's statement?

Actually, that is also clear.
The prosecution neglects the important point for
Yamagami that there may be some relationship
between Shinzo Abe and the religious group, or
rather considers the relationship negatively from
the head. ... Or, as the media reported immediately
after the arrest that Yamagami "believed" that the
former Prime Minister Shinzo Abe had something
to do with the religious group, according to
Yamagami's statement, the prosecution may be
trying to treat it as a "belief of Yamagami." un-
known. I presume that is the "reason" for Tetsuya
Yamagami to give a psychological assessment.

In other words, Shinzo Abe and the particular
religious group had nothing to do with each other,
but Yamagami had a "delusion" that they had a
relationship with each other. The prosecution's
story is that Tetsuya Yamagami's statement is a
"logical failure" because he has an abnormality in
his mind. Once this prosecution's story is fina-
lized, the prosecution can leave to touch on the
problem about relationship between former Prime
Minister Shinzo Abe and the Unification Church,
which is currently being explored and reported by
the media. i feel that is the idea of the prosecution.
Inline with this idea, the case may be brought to
trial.
The appraisal detention period is 4 months
from July 25th to November 25th. It's quite
long.

I do not defend Tetsuya Yamagami as a
shooting murderer at all. However, the incident
caused by this man may have begun to reveal the
wide and deep "darkness" of Japan, which is
surprising to many Japanese people. And that deep
darkness may extend deep into the prosecution's
organization.
Depending on the result of the psychological
examination, the sentencing of the criminal who
shot and killed the former prime minister will, of
course, be a matter of light or heavy punishment.
The prosecution, which normally demands strict
punishment for serious criminals, may want to
leave it untouched, even if it dares to abandon the
heavy sentence. That is likely to be unexpectedly
revealed to the prosecutor's office. So maybe they
thought about the suspect's"psychiatric assessment"?
And now, "the state funeral" of Shinzo
Abe is quite convenient for blindfold the people.

I want to say that, of course, that is not the
case. However, with regard to this appraisal
detention, I feel the odor of "water leaked
from their skilled hands".

As my own policy, I try not to say or write by
guessing as much as possible. Today's descrip-
tion broke that ban.
From this case, the prosecution's trends, and
the subsequent trials to the judgment, I will pay
attention to the future.

　July 27, TBS NEWS DIG video. ...At a press
conference related to incumbent ministers, etc., when
the reporter asked Mr. Satoshi Ninoyu, the chairman
of the National Public Safety Commission, "Is it
true that you chaired the 2018 Kyoto Prefectural

Prime Minister Shinzo Abe and the Unification Church
becomes true as stated by Tetsuya Yamagami, a
"simple" murder case called the assassination of the
former Prime Minister. It will be inevitable that it will
develop into a big political problem that never ends.
The prosecution probably knows the depths. There-
fore, they definitely want to avoid and prosecute.)
